Divorce Information
Jersey City and Newark, New Jersey
Divorce is one of the most difficult, traumatic events a couple or family can face. With divorce typically come uncertainty, anxiety, difficult decisions, and major life changes. When children are involved, the stress is only compounded because the couple divorcing knows they must make decisions that will be best for their children, and not for themselves.
While everyone hopes for an amicable divorce, they rarely happen. Instead, divorce can be a very long drawn-out, contentious process that involves lawyers, mediation, asset division, child custody, alimony, and palimony. If you are facing divorce, it is absolutely imperative that you have a lawyer on your side who has experience in the most difficult divorce cases and will fight aggressively to get all to which you are entitled. At the Law Offices of Anthony Carbone, P.C., we take each case very seriously and will work tirelessly to get you a fair settlement and ensure your children’s best interests are the primary concern.
New Jersey divorce lawyer, Anthony Carbone, has over 20 years of family experience; he is a tough litigator who will make sure there is equitable division of property and debts, fair child custody arrangements, fair division of assets and payment of alimony or palimony. Mr. Carbone will not let your spouse take advantage of you.
Divorce and Child Custody Issues
When it comes to child custody issues, our investigation will attempt to determine the following:
- Who is the better parent?
- Which parent may be interfering with the other’s visitation rights?
- Which parent will look out for the best interests of the child?
- Is one parent trying to “brainwash” the child against the other parent?
When determining custodial issues, the courts will often seek the opinion of unbiased healthcare and educational professionals to help them decide what is best for the child or children of divorce. The investigation may include psychological evaluations and interviews with other family members or caretakers who have had contact with the children.
In some cases, a “Law Guardian” is appointed on behalf of young children; this is an independent lawyer who is charged with representing the child’s best interests. If the child is old enough to state which parent he/she wants to live with, the Law Guardian will make that known to the court. If a child has reached the age of 13 or 14 (varies from state to state), the child’s wishes will be considered in the court’s final decision.
It is highly recommended that you contact an experienced divorce lawyer if your marriage is breaking up. No matter how many assets or children you have, New Jersey divorce attorney Anthony Carbone will fight for your rights. Please contact us today to schedule a confidential consultation.
