Understanding the Factors the Court Will Consider

If your child custody case is contested, the judge may order a home evaluation and/or psychological evaluations of the child and the parents. He or she may also conduct an in camera interview with the child, at which lawyers and court staff will not be present.

After evaluating the situation, the judge will make decisions about both physical custody — who is primarily responsible for providing a home for the child — and legal custody — who is responsible for making decisions about important issues like health care and education.

 

The court may grant joint physical custody, or it may grant physical custody to one parent and visitation time to the non-custodial parent. The court will usually — but not always — grant joint legal custody. Once the child custody decision is made, it is legally binding, and the custodial parent must get court permission for parent relocation.
