Making the State Prove Its Case

First, we explain to clients the charges and the possible penalties. Then we explore the prosecution's case for grounds to dismiss charges: Did the officer have probable cause to stop you and search you? Was the search legal? Can police tie you to drugs (did they find the drugs on your actual person)? Did an undercover officer play by the rules? Is an informant or witness reliable?

If the state won't drop its case, Mr. Carbone takes every action to limit the adverse consequences. He will negotiate a plea bargain with the district attorney or fiercely represent you at trial to avoid or minimize a prison sentence.

Drug court has a very restricted program available to certain first-time and low-level drug offenders. In exchange for a guilty plea, you are placed under court-supervised treatment for one year. If you pass random urine tests and are not arrested again, the criminal charge is dismissed. Your record will show you were arrested and completed the program, but it does not appear as a conviction.
