Child Custody and Visitation

Mr. Carbone handles proceedings over joint physical custody and legal custody. He can also fight for sole custody if there is evidence of child abuse, drug or alcohol addiction, or other dangers to the child's welfare.

You need the court's permission to move out of New Jersey with the kids. We help relocating parents prove that it serves the child's best interests. We also represent noncustodial parents in challenging a move-away or seeking more vacation and holiday time as a trade-off.

Accurate Child Support

Many factors affect the level of child support: income, parenting time, school and child care costs, children from other marriages. If the noncustodial parent is self-employed or paid cash wages (food service, construction), income may be underreported. We use state guidelines to impute income or use the courts to obtain bank and tax statements to uncover true earnings.

We also handle emancipation proceedings to end child support. Children in the parents' "sphere of influence" may be entitled to support up to age 23. A court will determine if the child is self-sufficient, and whether a parent must help pay for college.

Grandparents' Rights

In New Jersey, grandparents have some rights to visitation. If you have been denied access to your grandchild after your son or daughter's divorce or death, Mr. Carbone will fight for court-ordered visits.
